Copyright Policy

ChurchTrac Software, Inc. respects intellectual property rights and expects its users to do the same. This page describes our policy regarding copyright complaints and our compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

ChurchTrac Is a Hosting Platform

ChurchTrac provides church management software that enables customers to manage their own data, files, and content within their own accounts. Content uploaded or managed by customers is solely their responsibility. ChurchTrac does not monitor, curate, or control user-uploaded content.

How to Submit a Copyright Complaint

If you believe content accessible through a ChurchTrac customer account infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the specific material you claim is infringing, with enough detail for us to locate it. Include the full URL to the infringing content (not just the URL of the page it is on).
  3. Your contact information, including your name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

Incomplete notices will not be processed.

Important Notice Regarding Third-Party Demand Letters

ChurchTrac is a platform host and is not responsible for content uploaded by its customers. Demand letters, invoices, settlement requests, or license fee demands sent to ChurchTrac, with or without following the DMCA process, will not be honored and will not receive a response. Our copyright process exists solely to facilitate the removal of infringing content per 17 U.S.C. § 512. If you believe content hosted on our platform infringes your rights, submit a complete takedown notice using the process above.

Counter-Notice Procedure

If you are a ChurchTrac customer and believe your content was removed due to a mistake or misidentification, you may submit a counter-notice to our designated agent. Your counter-notice must include:

  1. Identification of the material that was removed and its location prior to removal.
  2. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, mailing address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which ChurchTrac may be found, and that you will accept service of process from the complainant.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we may restore the content at our discretion.

Repeat Infringer Policy

ChurchTrac will terminate the accounts of customers who are determined to be repeat infringers of intellectual property rights in appropriate circumstances.
