ChurchTrac Terms of Service

a. The ChurchTrac Service and Terms. By using the products or services offered by ChurchTrac Software, Inc. ("ChurchTrac", also generically referred to as "we" or "us"), including, without limitation, all software, applications, products, videos, forums, social media, technical support and other associated services ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms"). We may update these Terms at any time. If we make significant changes, we will refresh the date at the top of this page. If you do not agree to these Terms, your only recourse is to not use the Service.
b. Your Church and Your Account. In these Terms the phrase "Your Church" refers jointly to you (an individual) and the organization you represent, together with any and all users, members, representatives, employees or agents of the organization who access the Service. Your Church may be referred to generically as "you" or "your" or "your church". Anyone from Your Church who accesses or uses the Service is bound by these Terms. Use of the Service itself constitutes acceptance of these Terms, whether or not the user has formally indicated agreement. Your access to the Service is provided through your account or subscription ("Account") with us.
a. Precedence of Terms. These Terms constitute the governing agreement between you and ChurchTrac. In the event of a conflict between these Terms and any other agreement, policy, or communication (written or oral), these Terms shall control and take precedence. Violation of these terms may, at our discretion, result in us terminating your Account.
b. Accurate Information Required. You must provide your full name, your Church's full name, a valid email address, and any other requested information to complete the signup, payment, or support process. All information must be accurate, with no abbreviations or omissions. We may, at our discretion, terminate or restrict access to any Account with false or incorrect information. By signing up for the Service, you consent to our use of your contact information for follow-up or internal purposes.
c. Ownership of Your Data. By using the Service, you will be entering, importing, and storing data about yourself, your organization, and your organization's membership, structure, operations, finances, communications, and activities (collectively, “Data”) on our servers. You retain ownership of the Data you enter while using the Service, but you grant us all rights, consents, and permissions necessary to host, process, use, and access the Data for the purpose of providing, maintaining, supporting, and improving the Service. In the event that you close your Account, or in the event your Account is terminated for any reason, we may retain your Data within the Service or in backups for a limited period, generally not exceeding 90 days, but we are under no obligation to do so.
d. Privacy Commitments. We will not sell, rent, or lease your Data to any third party. We may share your Data with third parties as necessary to provide you access to the Service, or for other legitimate business purposes related to operating, maintaining, supporting, improving, or continuing the Service. This may include, without limitation, sharing Data with trusted third parties under appropriate confidentiality obligations for purposes including, but not limited to, audits, compliance, legal requirements, or internal reviews. We may also use or disclose aggregated, anonymized, or de-identified data for analytics, research, reporting, denominational insights, or other purposes that do not personally identify Your Church or its members.
e. Compliance with Applicable Laws. You acknowledge that it is your responsibility to comply with any and all local, state, regional, national, and international laws, rules, or regulations that relate to your organization and to your collection and storage of data. Depending on your region, you may need to acquire written permission from individuals to upload and/or store their personal data using the Service.
f. Our Intellectual Property; Your License. ChurchTrac retains all ownership rights regarding the Service, including but not limited to any trademarks, copyrights, patents, images, user interfaces, design, source code, technologies, and other intellectual properties (registered and unregistered) that make the Service possible. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from ChurchTrac. With your Account we grant you a license to access the Service on a limited, non-exclusive, revocable, non-sublicensable, non-transferable basis for ministry-related, non-commercial purposes only. It is in ChurchTrac's sole discretion to determine whether your use of the Service constitutes ministry-related, non-commercial purposes.
g. Internal Disputes and Account Access. Although your Church owns the Data entered into the Service, there may be situations where it is unclear who has the right to access it. In the event of an internal conflict or dispute within your Church or between users associated with your Account, we may temporarily limit or restrict access to the Service until we determine which users should have rightful access. Such conflicts may include, but are not limited to, staff terminations, church splits, hostile takeovers, or unauthorized users. We recommend limiting Admin users to one or two, as Admins can delete users and modify account permissions. Ultimately, in the event of an internal conflict at Your Church, we reserve the sole discretion to determine which users or parties will be granted access to the Account and Data.
h. Account Security. You are responsible for maintaining the security of your Account and password and for ensuring that any of your users do the same. This includes, but is not limited to, keeping your username, password, and related information confidential. We recommend that you use a strong, unique password and enable two-factor authentication for added security. You are responsible for all activity conducted under your credentials. We are not liable for any loss, damage, or unauthorized access resulting from weak or compromised credentials, phishing or smishing attempts, password reuse, or other failures to secure your Account at the individual level. Such incidents are not considered a breach of the Service; securing your Account and ensuring only authorized users access the Service is solely your responsibility. We recommend that you follow and implement our
recommended security protocols.
i. User Accounts. Each user account or login may only be used by one individual; shared logins are not permitted. All users, including administrative users and Connect (church member) users, are bound by these Terms when using the Service. Your Account typically includes a minimum of ten user accounts, subject to plan structure and our discretion. Larger name-tier plans may include more than ten user accounts at our discretion. Additional user accounts can be requested once you reach the number allotted for your subscription plan. We reserve the right to charge a fee for additional user accounts beyond our typical allotment.
j. Fair Use. Your use of the Service must not interfere with the ability of other users or customers to access or use the Service. Excessive or abusive use of the Service, including disproportionate consumption of system resources or attempts to bypass usage limits, may result in additional fees or suspension of access at our sole discretion.
k. No System-Level or API Access. Your use of the Service does not give you access to the system, or the technologies used in providing the Service, nor are you granted API-level access to the Service.
l. No Data Manipulation. You will not attempt to enter more than one first name per record in order to bypass the name limit of your purchased tier or subscription, or to perform any other manipulation of data to avoid purchasing an item, product, or upgrade that you would otherwise be required to purchase.
m. Purpose and Intended Use. The ChurchTrac mission is "To
EQUIP the Church, to build the body of Christ". The Service is specifically designed to assist and support churches, ministries, and organizations that operate in alignment with traditional Christian scripture and values consistent with traditional Christian teachings. For clarity, what constitutes alignment shall be determined exclusively by ChurchTrac, in its sole discretion.
n. Not a Public Forum. You acknowledge that the Service is a private platform operated by ChurchTrac and is not a public forum. Neither you nor any user, member, or participant has any right or expectation of free-speech protections when using the Service. ChurchTrac reserves the right, in its sole discretion, to remove, restrict, or block any content, activity, or user account. We may exercise this right for any reason or no reason, with or without notice, at any time.
o. Public Content. You are responsible for all content posted to and activity that occurs under your Account, including content posted by and activity of any users in your Account. All public-facing use of the Service, including but not limited to websites, apps, media, announcements, SMS messages, emails, push notifications, and other communications, must comply with the following standards. You may not use the platform to create, post, transmit, distribute, or send content that:
- Violates any part of these Terms, including the Purpose and Intended Use provision above;
- Promotes or depicts murder, torture, racism, or other violence against individuals or groups;
- Contains blasphemy or any sexual, religious, political, commercial, controversial, offensive, or other objectionable content that, in ChurchTrac's sole discretion, conflicts with the Purpose and Intended Use provision above;
- Promotes hostility toward or disparages the Christian faith or Christian communities;
- Is obscene, vulgar, defamatory, harassing, fraudulent, misleading, unlawful, or harmful.
All determinations regarding whether or not any content is in violation of these standards are made at ChurchTrac's sole discretion.
p. ChurchTrac's Right to Refuse, Deny, Limit, or Terminate Service. ChurchTrac reserves the right, with or without cause, at its sole and absolute discretion and with or without notice, to refuse, deny, restrict, limit, discontinue, suspend, or terminate service, accounts, or access to any person, organization, or entity. This includes the right to accept, cancel, or reject registrations or access to the Service, and to immediately remove any Account, Data, content, or communications that violate these Terms, are inconsistent with the Purpose and Intended Use provision, are required by law or regulation, or that we otherwise deem necessary. All decisions regarding enforcement of these Terms, including account suspension or termination, shall be final and binding, to the maximum extent permitted by law.
a. Internet Access Required. An internet connection is required to use the Service. You are responsible for acquiring internet access, including any equipment necessary to access the Service, at your own expense. We are not responsible for any charges you incur while accessing the Service, including but not limited to data fees or overages from your internet service provider. We cannot guarantee the operability or general availability of the Internet or any other network or device you rely on to access the Service.
b. Availability of the Service. We do not warrant that the Service will be available all the time, or at any particular time. Many factors can impact availability. When outages are within our control, we will work diligently to restore access as quickly as possible. From time to time, we may restrict access temporarily for maintenance, updates, or upgrades. You agree that no compensation or credit will be provided for any disruption in service, even if caused by us. In the event of a natural disaster or other event that renders the Service unavailable for an extended period, we will make reasonable efforts to inform you of the outage, the steps we are taking, and when we expect access to be restored.
c. Supported Browsers and Equipment. For best results, we recommend the use of Chrome, Firefox, or Safari browsers. Only current, up-to-date versions of recommended browsers are supported. Older or outdated versions are not supported, even if the browser itself is generally recommended. Third-party browser plug-ins, extensions, toolbars, or add-ons may cause conflicts with the Service. Malware, proxies, and script- or content-blocking software may also cause performance issues. We are not responsible for any access or performance problems caused by your equipment, browsers (whether supported or not), or conflicts with other software on your network or devices.
d. Technical Support. We generally provide technical support only to users listed on your Account or to authorized contacts, during our regular business hours. We reserve the right to charge a fee for support requests that exceed what we consider normal or reasonable, or for support required outside of our regular business hours. We do not guarantee support at a specific time or within a specific timeframe. Support policies and rates, if applicable, will be posted on our website or provided to you on a case-by-case basis. You agree that any support provided by us through phone, Zoom, or other channels may be recorded for quality assurance or internal purposes.
e. Member Features. Certain features of the Service allow your church or organization members to access and update their own profiles and information. These features may also make certain reports available that contain personal or contact information of other members. If you enable these features, it is your sole responsibility to ensure that no confidential information is exposed through the member portal. You accept full responsibility and liability for any sharing or breach of information that occurs through member access.
f. User-Generated Content. You are responsible for all content posted to and activity that occurs under your Account, including content posted by and activity of any users in your Account. Our platform allows users to share their own content, including images and written material. We do not pre-screen or endorse user content and we are not liable for their accuracy or legality. We reserve the right (but not the obligation) in our sole discretion to refuse or remove any content.
g. Intellectual Property Rights of Others. You are responsible for ensuring that all content posted by your Church, including material from your users or members, does not violate the intellectual property rights of others, including copyrights and trademarks. Posting infringing content is strictly prohibited. If you believe your rights have been violated, you may contact us through our Support Ticket system. We reserve the right to remove any content we believe infringes on intellectual property rights and may terminate accounts of repeat offenders. By using our platform, you agree to indemnify and hold us harmless from any claims arising from infringing content posted by you or your Users.
h. AI-Powered Support Disclaimer. ChurchTrac may provide automated assistance through artificial intelligence (AI) tools or chatbots to help answer questions or provide support. Responses generated by AI are for informational purposes only, may not always be accurate, complete, or up-to-date, and should not be relied upon as professional advice. All official support, account changes, or binding commitments must come directly from a ChurchTrac employee. ChurchTrac disclaims all liability for any reliance on information provided by AI tools.
i. Children's Privacy. Your Church is solely responsible for complying with COPPA or similar child-privacy laws. You may not enter data about children without appropriate parental/guardian consent. We do not knowingly collect data about children under 13 without such consent. If we learn that we have collected personal information about a child under 13 without parental consent, we will delete that information promptly.
a. Subscription Fees. You agree that we will charge you a fee to provide access to the Service. Your access is limited to the term of your subscription. We may display payment-due notices when your Account is approaching or past due, and we may attempt to notify you by phone and/or email, but we are not obligated to do so. It is your responsibility to ensure that we have accurate and current contact information. We will suspend access when your Account becomes past due. At our discretion, we may grant a grace period, but failure to make payment will result in removal of both your Data and your Account as described below.
b. Abandoned Accounts. Any Account that, in our sole discretion, is determined to be inactive, abandoned, or delinquent may be suspended or removed at any time, along with any associated Data. While we may attempt to notify you before removal, we are under no obligation to do so.
c. Late Payments. Payments received after the due date will extend your access from the due date, or in some cases from the date of payment, at our discretion.
d. ACH Payments. Customers in the United States may be able to pay using ACH. If you select ACH, you agree that we may charge you a fee (not to exceed $15.00 USD) for each failed or returned payment. Reasons may include insufficient funds, closed accounts, or accounts not set up for ACH.
e. Automatic Renewal. We will automatically charge your payment source (card or bank account) on your monthly subscription renewal date. It is easy to cancel your subscription using our cancelation form. See the section below labeled "Account Access, Cancellation and Termination" for additional details on closing your Account and terminating your subscription.
f. Refund Policy. You can cancel your Account at any time. No refunds are available for monthly subscriptions. Annual subscriptions, which include a discounted rate, are typically non-refundable, but are evaluated on a case-by-case basis. Any refund granted is at our sole discretion and may be pro-rated or reduced from the original payment amount. We may subtract the value of non-refundable add-ons, discounts, promotions, or upgrades from any refund amount. No refunds will be given for service dates prior to receipt of your cancellation form, even if you did not use the Service during that period. There are no refunds on messaging products, or credits provided for unused messaging.
g. Exporting Your Data. Prior to closing your Account, you may request a copy or export of your Data. Requests made after expiration or cancellation may not be fulfilled. We reserve the right to deliver your Data in a format of our choosing, which may not be transferable to another service. We may charge a fee up to $50.00 USD to process a data export request. If restoration from an offsite backup is required, additional data restoration fees may apply.
h. Outstanding Balances. If you close your Account with an unpaid balance exceeding $1.00, you authorize us to charge your card to settle the balance prior to closure. If payment cannot be processed, you agree to promptly submit payment directly.
i. Data Restoration After Removal. If your Account is terminated or removed for non-payment (or any other reason), we may, at our discretion, restore it from an existing backup (if available). Backups are not retained indefinitely and are not guaranteed. If you or your users delete critical Data, we may restore from an earlier backup (if available), for a per-incident fee in addition to your subscription cost. Accounts restored after removal for non-payment must also be renewed for at least one month at your current tier and plan, and subscription pricing will be based on our then-current published rates.
a. Base Price and Subscription Terms. The base price per name tier is locked to the subscription rate in effect when your Account is created. This price remains unchanged for at least the duration of your subscription term (monthly or annual). Add-ons or upgrades purchased before renewal may be charged at the then-current rates. We generally attempt to keep your base price consistent upon renewal; however, your price is subject to change at your next renewal date, with or without notice. Notice may be given by posting updates on our website(s) or within the Service. At our discretion, we may automatically move your Account to a newer plan or pricing model. Current pricing will always be published on our website(s).
b. Access to New Features. New features may be introduced on an opt-in basis or may be limited for Accounts that remain on older subscription plans. In such cases, you may switch to a newer plan to access those features.
c. Service Changes and Feature Availability. We reserve the right to suspend, downgrade, or discontinue any aspect of the Service, including the availability or functionality of features, without notice, at any time. We may also impose limits, restrict access, or remove certain features at any time.
d. No Liability for Changes. ChurchTrac shall not be liable to you or any third party for any modification, price change, suspension, discontinuation, or removal of the Service, any part of the Service, or any third-party integration.
e. Applicability of Terms to New Features. Any new features, tools, or resources that augment or enhance the Service are automatically deemed part of the Service and subject to these Terms. Your continued use of the Service after such changes constitutes your acceptance of them.
a. Use of Messaging Features. By using messaging features built into the Service (including, but not limited to Email, Voice, and Text/SMS messaging), you agree to abide by the additional terms in this section.
b. Messaging Usage Fees. You acknowledge that certain messaging features may incur a cost that is not covered by your plan subscription fees or costs. We will periodically charge your card or stored payment method for any usage fees which are incurred by your Account. In the event we are unable to charge your stored payment method for usage charges, you agree to manually submit payment for any such usage charges.
c. Customer Liability for Messaging Costs. You understand that any voice or SMS broadcast sent by you may incur a charge for recipients of that message. In no way are we to be held responsible or liable for these charges, or for any other charges incurred by you or recipients of your message. You agree to pay any fees or claims against ChurchTrac Software, Inc. by any recipient of any messages you send, or that are sent on your behalf.
d. Deliverability Disclaimer. We do not guarantee that all recipients will be capable of receiving messages sent by you, or that a particular carrier or provider will support or deliver messages sent by you.
e. Right to Limit or Suspend Messaging. You agree that we may limit or suspend your use of the messaging features for any reason we deem appropriate.
f. Limitation of Liability. In no way are we responsible or liable for any unavailability or limitation of any messaging feature, even if the unavailability or limitation is caused by us.
g. No Messaging Guarantee. We do not warrant that the messaging features will be functional at all times, nor do we guarantee that all or any messages will be delivered. Network issues, including issues outside of our control, may affect the deliverability of messages sent through the Service.
h. Messaging Limitations We do not guarantee that messaging features will work with all providers. Messaging features may not be available in all geographic regions or locations.
i. Opt-In Sending Only. You may send messages only to individuals in your database who are associated with your organization and who have opted to receive messages from you. Under no circumstances shall you send messages to individuals or organizations who have opted not to receive messages from you. Your Church is responsible for honoring member opt-out requests regarding communications, directories, or visibility within the Service. You must remove any such names and contact information from your database within ten (10) calendar days of receiving the opt-out request. You must comply with all applicable telecom and email laws.
j. Messaging Protocols. You agree to follow good messaging protocols, rules and standards, which are listed on the messaging pages within the application.
k. Messaging Limits. Carriers and service providers may limit the number of messages that you can send per hour, day, or other time frame. Some providers may prevent delivery or block your messages if they determine that you have exceeded a threshold of messages to their customers within a specific time frame of their choosing. We are in no way liable to you or responsible for any restrictions that carriers or service providers may impose on your ability to send messages to their customers, or for any other deliverability issues that may arise.
l. Prohibited Messaging Use. The following behaviors are not permitted: sending unsolicited messages, sending mass marketing or bulk messages, sending harassing or abusive messages, engaging in fraud, phishing or sending of sensitive data, misrepresenting your identity (spoofing), or any other practice that we, in our sole discretion, deem inappropriate. We may suspend or close your Account if we determine that you are engaging in these or similar practices. Engaging in spamming or other unsolicited advertising, marketing or other activities, including, without limitation, any activities that violate anti-spamming laws and regulations including, but not limited to, the CAN SPAM Act of 2003, the Telephone Consumer Protection Act, and the Do-Not-Call Implementation Act.
m. Messaging Complaints. If we receive any complaints from recipients, carriers, or providers regarding your use of messaging features, we reserve the right to limit, suspend or terminate your Account, at our sole discretion. Complaints may include, but are not limited to, your use of messaging features to send SPAM, commercial, illegal, pornographic, offensive, harassing, libelous, abusive, threatening, hateful, harmful, vulgar, distasteful, defamatory, indecent, objectionable or inappropriate messages. Additionally, complaints may also come from recipients of a legitimate message who have requested to be removed from your delivery list. You agree that any complaints that result in fines, fees, damages or charges will be paid by you.
n. Ministry-Related Use Only. All messages sent through the Service must be for ministry-related purposes only and may not be used for commercial, solicitation, or marketing activities.
o. Resell Prohibited. You may not sell or resell messaging features or use the messaging features for purpose that is not directly associated with the ministry of your church.
p. Messaging Credits. For some customers, the sending of messages through the Service may require the purchase of credits. Unused credits may have an expiration date. If not explicitly posted, the expiration date on messaging credits is 365 days from the date the messaging credits were purchased. After the expiration date you forfeit any unused messaging credits.
q. Emergency Use Prohibited. The messaging features of the Service should not be used for emergency-related needs, or for delivering information of critical importance. Messages should be informational and not promotional in nature. You should never use the messaging features of ChurchTrac to attempt to sell a product or service.
r. No Messaging Warranty. We provide the messaging features on an "as is" and "as available" basis with no guarantee or warranty of any kind, whether expressed or implied. If you access or transmit any data through the Service, you do so at your own discretion and risk.
s. Third-Party Messaging Service. We may provide you with the option to connect with and send messages through a third-party messaging service. We are not endorsing or recommending any third-party provider, even if we provide an integration to a particular provider. We may charge you a fee to enable a third-party integration, which will be in addition to your normal subscription fee. Any integration with a third-party service is provided "as is" with no guarantees or warranties. Not all third-party services will be compatible with the ChurchTrac Service. If third-party messaging service is enabled for your Account, the third-party will charge or bill you directly for any messaging usage on their platform, including messages you send through the Service. These charges are in addition to and separate from any charges for your ChurchTrac plan or subscription. You accept all fees charged by the third-party messaging service and agree that these fees are solely the responsibility of your church; ChurchTrac will not be responsible for any third-party fees or charges either to you or your message recipients. The fees charged by the third-party messaging service may vary by region or by country. Longer messages may incur higher fees from the third-party messaging service. Third-party integrations may not be available in all regions. ChurchTrac does not guarantee that any third-party service will always be available or that it will continue to work with the Service. Failure to maintain an account in good standing with the third-party messaging service will likely result in your inability to send messages through the ChurchTrac Service. We may choose to discontinue an integration with a third-party service at any time, with or without notice to you.
t. SMS Messaging. Sending SMS through ChurchTrac is billed to your Account on a per-message basis at our published rates. ChurchTrac legacy plans may include a limited number of free SMS messages each month. If you enable a third-party messaging service, ChurchTrac will no longer provide any free SMS messages, regardless of the plan you have selected, and all messages sent from the Service will be billed or charged to you by the third-party messaging service. The third-party messaging service may or may not provide any free messages or credits. ChurchTrac will not provide any credit or reimbursement to you for messages that were charged to you by the third-party messaging service.
u. Incoming SMS Messages and Fees. Any SMS messages received on your ChurchTrac-assigned phone number, including replies to outgoing messages, unsolicited incoming messages, and spam, may incur a charge. All incoming SMS message segments are billed to your Account at the then-current per-recipient rate established by ChurchTrac, regardless of content or sender. You acknowledge that these fees apply automatically and are non-refundable. If you use a third-party messaging provider, any fees for incoming messages will be charged by that provider at its established rates, and ChurchTrac shall have no responsibility or liability for such charges.
v. SMS Opt-In. Before you send an SMS message to a recipient for the first time, we will send a required opt-in message to that recipient. This opt-in message counts as an additional "recipient" or segment for billing purposes. If you are using a third-party messaging service, the charge will be assessed by the third-party messaging provider at their established rate. Any reply, including a reply to the required opt-in message, is also billable as a message segment by the standards set forth in this section. If the recipient fails to reply, or if a recipient replies with "No" (opt-out), you must remove the number from your database and no longer attempt to send SMS messages to that number.
w. Undelivered SMS Messages. An SMS message sent to an invalid or opt-out number may still be billable or charged as a recipient, even if the message is not delivered to the intended recipient. While we attempt to prevent repeat sending to invalid or opt-out numbers, it is your sole responsibility to remove these numbers from your database. Some messages may be undelivered due to carrier-level restrictions or filters. You agree that we are not required or obligated to provide you a credit or reimbursement for undelivered messages, regardless of the message type or messaging provider.
x. Email Usage. We may provide you with the ability to send emails through the Service. Email (as well as other messaging features) may not be available for all plans or subscriptions or regions. You agree to not send an unreasonable number of emails or other messages using the service. The number that is considered reasonable is solely determined by us and will vary based on the tier of service you have purchased. We will attempt to notify you if we believe your usage is excessive. You agree that we have the right to limit your usage based on what we deem appropriate.
y. Email Bounces and Complaints. If we detect excessive bounces, spam complaints, or other deliverability issues arising from messages sent through your Account, we may, in our sole discretion, limit, suspend, or terminate your messaging capabilities or your entire ChurchTrac Account without prior notice. You acknowledge that maintaining proper recipient lists and complying with all applicable email and anti-spam laws (e.g., CAN-SPAM, GDPR, CCPA where applicable) is solely your responsibility. If your messaging or Account access is suspended due to such issues, we reserve the right to charge a reinstatement fee, require corrective actions, or refuse reinstatement altogether.
z. Messages are not Private. Messages sent through the Service, regardless of medium (including email, SMS, voice, or push notifications), are not private. You acknowledge and agree that ChurchTrac employees or agents may access, review, and monitor messages for purposes including, but not limited to, spam detection, prohibited content review, troubleshooting, compliance, or system security. Messages may be automatically scanned and flagged, and any flagged message may be subject to manual review. At our sole discretion, we may approve, reject, delete, block delivery of, or otherwise take action on any outgoing or queued message that we determine to be inappropriate, in violation of these Terms, or otherwise objectionable.
a. Requirement for Stripe Account. Online Giving is a ChurchTrac feature that is processed through an integration with Stripe, a third-party payment and merchant account provider. ChurchTrac is not a payment processor. A Stripe account is required to process online giving through ChurchTrac. Your church will be the owner and the sole responsible party for your Stripe account. Your church assumes all responsibility and liability for any fees or charges imposed by Stripe. This includes (but is not limited to) processing fees, dispute fees, chargebacks, and refunds. Use of the Stripe service is also subject to Stripe's Terms and Conditions.
b. Stripe Fees and ChurchTrac's Role. Stripe is a third-party company that is not affiliated with ChurchTrac, and ChurchTrac is not a party to the merchant relationship between Your Church and Stripe. Stripe charges processing and other fees to use their merchant processing services. Stripe's fees are set by Stripe and are not determined or controlled by ChurchTrac. You may have the ability to negotiate a better rate with Stripe by contacting them directly. ChurchTrac does not add any mark-up to Stripe's fees or add any additional processing fees when using our Online Giving feature. However, ChurchTrac reserves the right to limit or prevent access to ChurchTrac's Online Giving feature on a case-by-case basis at our sole discretion.
c. Data Access and Privacy. When a Stripe account is connected to the ChurchTrac platform, we will have access to a limited set of data on that Stripe account. For example, Stripe shares certain data with ChurchTrac, allowing us to create charges on behalf of your donors, as well as providing us the necessary information to update your database when a contribution is received. ChurchTrac does not store or process card or bank account data on its servers, nor do we at any time have access to your bank account information or the financial information of your donors. Stripe shares a limited set of other data from connected accounts, which we may use to assist with troubleshooting or setup. Our access to this data is governed by our Privacy Policy. ChurchTrac disclaims all liability for any breach, misuse, or unauthorized disclosure of data by Stripe.
d. Donor Fee Option. When enabled by your church, ChurchTrac will ask a donor using a credit or debit card if they wish to increase their gift or contribution amount to help cover the estimated processing fees that will be charged by Stripe. You can turn this feature on or off in ChurchTrac's Online Giving Settings. When enabled, and when the donor chooses this option, ChurchTrac will estimate the Stripe fee by adding a flat 3% (three percent) plus 30 cents to the donor's original gift amount. The actual processing fee charged by Stripe may be different from the estimated fee calculated by ChurchTrac. The calculation provided is only an estimate; Stripe alone determines the actual processing fees applied to each transaction. When selected, the donor is not actually "paying" the Stripe fee on behalf of the church; they are simply increasing the amount of their donation to help the church cover the estimated fee that will be charged by Stripe. Ultimately, your church is solely responsible for the fees charged by Stripe. In no event will ChurchTrac be responsible or liable for fees or charges incurred by you in connection to using Stripe's services or ChurchTrac's Online Giving features. ChurchTrac does not collect or charge any fees associated with online giving, nor does ChurchTrac receive any part of the fee charged by Stripe.
e. Security Settings and Responsibility. ChurchTrac provides various settings and options to help secure your Stripe account from fraud, including our recommended settings of requiring donors to register and requiring donors to be approved before they can give online. You are ultimately responsible for any charges on your Stripe account, and for understanding the appropriate ChurchTrac settings and options to help secure your ChurchTrac and Stripe accounts. ChurchTrac is not responsible for any fraudulent charges, unauthorized transactions, or losses arising from Your Church's use of either Stripe or the ChurchTrac platform.
a. Use and Disclosure of Data. We will not intentionally use, disclose, or distribute your Data without your consent, except as reasonably necessary to perform under these Terms, or for other legitimate business purposes related to the operation, maintenance, support, or continuity of the Service.
b. Encryption and Limitations of Security. We use commercially reasonable security measures to protect your Data. However, no system is completely secure or immune from malicious attacks, equipment failure, acts of God, or unauthorized disclosure. To the maximum extent permitted by law, we disclaim all liability for any unauthorized access to, disclosure of, or loss of Data, whether or not resulting from a breach of our systems. Your sole and exclusive remedy for any such event is as provided under the Limitations of Liability section of these Terms. In the event of a security incident or data breach, we will provide notice to you as required by applicable law.
c. Your Responsibility for Security. You are solely responsible for preventing unauthorized access to your Data, whether by third parties or by users under your control. This includes safeguarding usernames, passwords, Data, and any other proprietary materials. Without limitation, you assume all risk and liability for: (i) printed reports being accessible to others; (ii) users who fail to log out of the Service, leaving their sessions open; (iii) access to the Service from malware-infected or otherwise compromised devices; and (iv) sharing or disclosure of credentials to unauthorized parties.
d. Managing User Access. You are solely responsible for granting, monitoring, and revoking User access to the Service. You must promptly disable or modify credentials and permissions when a User's role changes or a User is no longer authorized. You assume all risk and liability arising from any access, action, or omission by your users, including any failure to timely update or revoke access.
e. Access to and Modification of Data. ChurchTrac employees and agents may access or modify your Account and Data as reasonably necessary to operate, maintain, support, or improve the Service. This may include, without limitation: (i) troubleshooting, technical support, maintenance, training, or operational services; (ii) modifications from updates or upgrades; (iii) access by authorized personnel during error reporting, diagnostics, or system monitoring; (iv) compliance with applicable laws, regulations, subpoenas, law enforcement requests, or court orders; (v) billing, fraud prevention, or other security measures; or (vi) importing, processing, or restoring Data. You may disable Support Team access in Administrator Settings, which prevents our Support Team from direct troubleshooting access to your Account; however, certain Data may still be accessed or processed for the purposes described above. By using the Service, you consent to such access and modification.
f. Data Provided Through Support. If you provide Data through support tickets, email, or other communication channels, such Data may be stored or retained in those systems after the support incident concludes and will not automatically be deleted. We are under no obligation to remove such Data unless you make a specific written request, and even then, removal may be limited by our operational, legal, or archival requirements.
g. Data Backups. We may retain backups of your Data while your Account is active and for a limited period after it becomes inactive. You may request in writing that we remove such Data, and we will use commercially reasonable efforts to comply within three business days. We do not guarantee that all backups can be fully erased, and residual copies may persist in archival or disaster recovery systems for a limited time.
h. No Sale or Lease of Data. We will not sell, rent, or lease your Data to third parties. We may share your Data with third-party providers as necessary, typically to enable or provide supplemental features of the Service (e.g., payment processors such as Stripe; messaging providers for email, SMS, or voice communications; integrations such as Song Select or MinistrySafe). We may also share or provide limited access to Data when reasonably necessary for business operations, compliance, or other legitimate purposes related to maintaining, supporting, or continuing the Service. Any such access will be limited to the extent necessary and subject to appropriate confidentiality obligations.
i. CCPA Service Provider Status. Under the California Consumer Privacy Act ("CCPA"), ChurchTrac is a "service provider", not a "business" or "third party", with respect to your use of the Service. That means we process any data you share with us only for the purpose you signed up for and as described in these Terms. We do not retain, use, disclose, or sell any of that information for any other commercial purposes unless we have your explicit permission. Similarly, you agree to comply with your requirements under the CCPA and not use the ChurchTrac Service in a way that violates the regulations.
j. Sensitive Data Prohibited. You must not store sensitive personal information (including but not limited to social security numbers, credit card numbers, healthcare information, bank account numbers, or passwords) in the Service. Such information may be visible to other users in your database and, in the event of a breach, could be exposed to unauthorized parties. ChurchTrac disclaims all responsibility and liability for the storage or disclosure of such information. Sensitive information of this nature should be maintained offline in secure, physical storage under your control.
k. Third-Party Links. The Service (including support pages, guides, and blogs) may contain links to third-party websites or other services. ChurchTrac makes no representations or warranties regarding, and expressly disclaims all responsibility and liability for, the content, accuracy, legality, availability, or practices of any third-party websites, materials, products, or services. Accessing such third-party resources is at your sole risk.
a. Prohibited Activities. You must not hack, reverse-engineer, modify, adapt, alter, interfere with, or attempt to gain unauthorized access to the Service or any related systems, networks, or data. Prohibited activities include, without limitation: penetration testing, excessive password guessing, denial-of-service simulations, running vulnerability scans, phishing, sniffing, brute-force attacks, or any other misuse of the Service. Any such conduct will result in immediate termination of your Account and may subject you to civil or criminal liability. All access attempts are logged, and your device's IP address and related identifiers may be recorded and used for security and legal enforcement purposes.
b. Subscription Cancellation. Your ChurchTrac subscription will continue until canceled. You are responsible for canceling your Account if you do not wish to continue. Cancellation must be submitted through the subscription cancelation form in Admin Settings within the ChurchTrac application. The request is considered received at the date and time the form is submitted. Upon cancellation, billing will stop immediately, except that we may process a one-time charge for any billed but unpaid usage fees (such as messaging charges). Submitting the form will not stop payments already in progress, and prior payments are non-refundable. We cannot honor cancellation requests made by email or phone. We may retain your Data for a limited period after cancellation unless you also submit a written request for removal in accordance with these Terms. Once removed, your Data may not be recoverable.
c. Non-Transferability. Your access to the Service is non-transferable. Any prepaid, unused balance is non-transferable.
d. Survival of Terms. All provisions of these Terms which by their nature should survive termination of your Account shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. The cancellation or termination of your Account, either by you or by ChurchTrac, does not negate or nullify your responsibilities and obligations under these Terms.
a. No Resale or Redistribution. You may not resell, sublicense, rent, lease, copy, distribute, or otherwise make the Service available, in whole or in part, to any third party. You may not charge any fee for access to the Service, nor permit use or access by any party outside your Church or authorized organization. Any such unauthorized use constitutes a material breach of these Terms and will result in immediate termination of your Account.
b. No Unauthorized Representation or Affiliation. You may not, without ChurchTrac's prior written consent, charge any third party a fee to set up, configure, or provide access to the Service. You may not represent, imply, or state, directly or indirectly, that you are affiliated with, endorsed by, or acting on behalf of ChurchTrac. You may not use ChurchTrac's trademarks, logos, or branding without prior written authorization. You must not modify, frame, or otherwise alter another website in a manner that falsely suggests association with the Service or with ChurchTrac.
c. Use of Third-Party Vendors. You acknowledge and agree that ChurchTrac uses third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology necessary to operate the Service and its features. ChurchTrac makes no representations or warranties regarding, and expressly disclaims all responsibility and liability for, any interruptions, errors, delays, outages, data loss, or failures caused in whole or in part by any third-party vendors, service providers, or hosting partners.
d. No Modification or Automated Access. You must not modify, alter, disable, or interfere with the Service in any way, including but not limited to injecting code, applying third-party software, or attempting to change, bypass, or extend the Service's intended functionality. You may not run scripts, bots, crawlers, scrapers, automated tools, or any non-human processes to access, interact with, or otherwise use the Service, except through features or integrations expressly provided or authorized in writing by ChurchTrac.
e. No Unauthorized Exploitation. You may not reproduce, duplicate, copy, sell, resell, exploit, or otherwise misuse any portion of the Service, your use of the Service, or your access to the Service without ChurchTrac's prior written consent.
f. Zero Tolerance for Abuse. Any verbal, physical, written, electronic, or other form of abuse, including threats, harassment, intimidation, or retribution, directed at any ChurchTrac customer, employee, officer, or agent will constitute a material breach of these Terms and will result in immediate termination of your Account. Such conduct may also subject you to civil or criminal liability.
g. No Unlawful or Harmful Content. You may not upload, download, post, email, transmit, or intentionally receive through the Service or ChurchTrac websites any content that: (i) is unlawful, illegal, or violates any applicable law or regulation (including export/import restrictions); (ii) is threatening, abusive, harassing, tortious, defamatory, obscene, libelous, or invasive of another's privacy; (iii) discloses private or confidential information of another person without consent; (iv) may reasonably incite others to engage in unlawful or harmful conduct; (v) contains viruses, malware, or other harmful code; (vi) infringes on any intellectual property or proprietary rights of others; or (vii) is otherwise objectionable as determined by ChurchTrac in its sole discretion. ChurchTrac reserves the right to remove or refuse to post any content that violates these Terms or is deemed inappropriate, without prior notice.
h. Compliance with Laws. You may not use the Service or the ChurchTrac website(s) in any manner that violates, or could reasonably be expected to violate, any applicable local, state, national, or international law, rule, regulation, order, or statute.
i. No Harm to Minors. You may not use or access the Service or the ChurchTrac website(s) in any manner that exploits, endangers, or causes harm to minors, including but not limited to the collection, storage, transmission, or display of any content involving minors that is abusive, inappropriate, or otherwise harmful.
j. No Viruses or Malicious Code. You may not upload, email, transmit, or otherwise introduce through the Service or the ChurchTrac website(s) any viruses, malware, spyware, or other harmful code, files, or programs designed to disrupt, damage, impair, intercept, or gain unauthorized access to any computer system, network, software, hardware, or telecommunications equipment. You are also prohibited from attempting to probe, scan, test, or otherwise gain unauthorized access to our systems, networks, or those of any other user or third party.
a. Hosting Services. ChurchTrac provides website, app, and content hosting through the Service. You are solely responsible for all content you publish or transmit, for your domain name, and for ensuring compliance with all applicable laws and regulations. We reserve the right, at our sole discretion, to suspend, restrict, or terminate hosting or related services in cases of excessive resource usage, security vulnerabilities, or any actual or suspected violation of these Terms. The Service is provided strictly on an "as is" and "as available" basis, without any warranties of any kind. We disclaim all liability for downtime, data loss, security breaches, or any damages or losses arising from or related to your use of the Service.
b. One-Time Website Build. We offer a one-time, paid website build service that includes creating and setting up a basic Church Connect website using one of our pre-designed templates selected by you. The build service is limited to the functionality and features available within the ChurchTrac platform and does not include custom coding or modifications beyond those capabilities. Once delivered, you are solely responsible for maintaining and updating your site content, as ongoing maintenance, redesigns, or additional customizations are not included in your subscription. The build service fee is non-refundable.
c. Domain Name Responsibility. You may use your own domain name with our hosting services, but you are solely responsible for all domain registrar fees, renewals, and optional services, none of which are included in your subscription. Failure to renew or properly manage your domain may result in your site becoming inaccessible or permanent loss of the domain name, for which ChurchTrac is not liable. We do not provide or manage email services for your domain. If you require email accounts, you must obtain them through your registrar or a third-party provider. While we may provide limited assistance as a courtesy, you remain solely responsible for managing and maintaining all DNS records and settings necessary to keep your site accessible.
d. Site Security and Customization. You may not add script tags, embed custom JavaScript, run server-side code, or include any other high-risk content that could affect site functionality, performance, or security. Limited CSS customization is permitted; however, you assume all risk and responsibility for any issues, display errors, accessibility problems, or unintended outcomes resulting from your modifications. ChurchTrac disclaims all liability for any adverse effects caused by your customizations.
e. Data Visibility and Privacy. You are solely responsible for the data and content you make available through your Church Connect pages or other public-facing areas of the Service. We strongly recommend that you do not post or store personally identifiable information (PII) on public pages or cards. You are responsible for complying with all applicable laws and regulations in your jurisdiction regarding data privacy, consent, and publication of personal information (including images of minors or individuals without consent). If you enable features such as the online directory, authenticated members may be able to view contact or other information of fellow members. Your Church is responsible for providing members with options to control what information is shared, and for disabling such features if there is any concern about inappropriate or unauthorized disclosure.
f. Attribution. If you use our Church Connect product or services, a "Powered by ChurchTrac" link will appear in the footer of your public pages. This attribution is a required part of the Service and may not be altered, hidden, removed, or obscured by any means, including but not limited to CSS, overlays, or other modifications.
g. Third-Party Links and Content. The Service may allow you to include links, embeds, or other content from third-party providers (e.g., YouTube, social media, or similar services). You are solely responsible for any third-party content you choose to display. ChurchTrac does not control, endorse, or assume any responsibility or liability for third-party links, embeds, or content, including their availability, accuracy, or compliance with law.
h. Content Standards for Creative Services. If we provide creative services to Your Church, such as building or setting up a website, app, or other content on your behalf, any and all material, images, written content, instructions, or other submissions you provide must comply with these Terms, including the Purpose and Intended Use provision, as determined by ChurchTrac in its sole discretion. We reserve the right, at any time and in our sole discretion, to refuse, remove, or decline to produce any content that violates these Terms or that we deem inconsistent with the Purpose and Intended Use provision. If we decline to produce content, we may, at our sole discretion, refund any fees paid specifically for that creative service. You remain solely responsible for providing compliant content and instructions and for ensuring you hold all necessary rights, licenses, and permissions to provide such content.
a. Connect Users. The following additional terms and conditions apply to "Church Members", defined as individuals who create or access member accounts through the public-facing website, mobile app, or member portal provided by Your Church using ChurchTrac's "Church Connect Services". These Church Members are distinct from users with access to ChurchTrac's administrative software and include individuals utilizing features including but not limited to church website, church app, member portal, online giving, event scheduling, or member directories. All other sections of these Terms of Service apply to Church Members where relevant, except where explicitly modified by this section.
b. Account Management. Your Church may grant, restrict, limit, or terminate a Church Member's access to the Church Connect Services at its discretion. ChurchTrac also reserves the right to restrict, suspend, or terminate access to any Church Member account for any reason, including but not limited to violations of these Terms, at our sole discretion without notice.
c. Account Responsibility. Church Members are responsible for maintaining the security of their accounts, including using strong, unique passwords and safeguarding login credentials. ChurchTrac is not liable for any loss or damage, including but not limited to unauthorized access, phishing, smishing, breaches, or other fraudulent activities. Church Members should immediately notify Your Church and ChurchTrac if they suspect their account has been compromised.
d. Single User per Account. Each Church Member account or login may only be used by one individual. Sharing login credentials with others is prohibited.
e. Church Member Conduct. Church Members must not engage in any activities that violate these Terms or applicable law. Prohibited conduct includes, but is not limited to: (i) phishing, smishing, or other fraudulent or deceptive practices; (ii) posting, uploading, or sharing content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, invasive of privacy, or otherwise objectionable, as determined by ChurchTrac in its sole discretion; and (iii) attempting to access, modify, or disrupt the Service or Church Connect features, including but not limited to hacking, reverse-engineering, or introducing malicious code. Violations may result in suspension or termination of access, removal of content, and any other remedies available to ChurchTrac at law or in equity.
f. Content Responsibility. Church Members are solely responsible for all content they post, upload, or share (e.g., profile information, comments, or images) through the Church Connect Services. ChurchTrac does not endorse, monitor, or exercise editorial control over user-generated content and acts only as a passive intermediary. ChurchTrac reserves the right, in its sole discretion, to remove any content that violates these Terms, and to suspend or terminate the accounts of Church Members who repeatedly post infringing, inappropriate, or otherwise objectionable content.
g. Intellectual Property. Church Members must ensure that any content they post does not infringe or misappropriate the intellectual property rights of others, including copyrights, trademarks, trade secrets, or other proprietary rights. ChurchTrac reserves the right, in its sole discretion, to remove or disable access to any content it believes may infringe such rights, and to suspend or terminate the accounts of repeat offenders. Your Church and its Members agree to indemnify, defend, and hold harmless ChurchTrac, its affiliates, officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to content posted by Members.
h. Ownership and License of Data. Your Church retains ownership of all data entered into the Church Connect Services, including data entered on behalf of Church Members (e.g., personal or family details). By using the Church Connect Services, Church Members grant to Your Church and to ChurchTrac a worldwide, royalty-free, non-exclusive license and all necessary rights to collect, process, store, display, transmit, and otherwise use such data as required to operate, maintain, support, and provide the Church Connect Services. This license includes the right for ChurchTrac to provide access to third-party service providers (e.g., messaging or payment processors) as reasonably necessary to deliver the Service.
i. Data Security and Accuracy. ChurchTrac uses commercially reasonable safeguards to protect data, but no system is immune from malicious attacks, equipment failures, unauthorized access, or acts of God. Church Members are solely responsible for ensuring that their profile information is accurate, secure, and updated, and for reviewing what personal or family information their Church makes available through the Service. ChurchTrac disclaims all liability for any unauthorized access, disclosure, or loss of data, whether or not resulting from ChurchTrac's negligence. A Church Member's sole and exclusive remedy in such cases is to request data removal or account closure through the Church Connect app, by contacting their Church, or by contacting ChurchTrac directly in accordance with the Data Removal section below.
j. Prohibited Sensitive Data. Church Members must not enter sensitive information (including but not limited to social security numbers, credit card numbers, bank account details, health information, or other sensitive personally identifiable information) into the Church Connect Services. Such data is not intended to be stored in the Service and may be visible to other authorized users (e.g., in member directories) or exposed in the event of a data breach. Church Members are solely responsible for ensuring that no such data is entered, and ChurchTrac disclaims all liability for any loss, disclosure, or misuse of such data. Any sensitive data that is inadvertently entered must be immediately removed by the Church Member or requested to be removed by contacting Your Church.
k. Data Removal. Church Members may request that Your Church update or remove their personal data from the Church Connect Services. Requests should first be directed to Your Church. If Your Church does not comply within three (3) business days, Church Members may submit a written
Support Ticket to ChurchTrac via our website. Upon receipt and successful identity verification, ChurchTrac will make commercially reasonable efforts to remove or anonymize the requested data within three (3) business days. Removed data may continue to exist in system backups or logs for a limited period, after which it will be purged in the normal course of business. ChurchTrac is under no obligation to recover deleted data. In jurisdictions with specific data protection laws (e.g., GDPR, CCPA), Church Members may exercise their applicable rights through Your Church or directly with ChurchTrac, subject to verification and applicable legal requirements. Where required by applicable law, we will comply with jurisdiction-specific privacy obligations. Otherwise, your rights and remedies are limited to those described in these Terms. In such situations, Your Church is the data controller; ChurchTrac is the processor. Requests must go through Your Church first, and ChurchTrac will only act on verified requests where legally required.
l. Online Giving. Church Members who use the online giving feature agree to comply with Stripe's Terms and Conditions, as all giving transactions are processed through Stripe, a third-party payment provider. Church Members are solely responsible for any transaction errors, disputes, or issues arising from their use of Stripe and should direct such matters to their Church. ChurchTrac does not store, transmit, or process donor payment information and disclaims all liability for any fees, chargebacks, disputes, or other issues related to Stripe or the online giving process.
m. Event Scheduling. Church Members who use scheduling features (including event registrations, volunteer sign-ups, or similar tools) agree to comply with Your Church's policies regarding cancellations, refunds, or changes. All scheduling decisions, obligations, and policies are the sole responsibility of Your Church. ChurchTrac provides only the software platform and disclaims all responsibility and liability for scheduling conflicts, errors, cancellations, refunds, changes, or any losses arising from use of these features.
n. Donor Fee Coverage. If enabled by Your Church, Church Members may be presented with the option to increase their donation to help offset estimated Stripe processing fees. This increase is voluntary and is treated solely as an additional donation, not as a direct payment of fees. The estimated fee is calculated by ChurchTrac for convenience only, and the actual fee charged by Stripe may differ. Your Church remains solely responsible for all Stripe processing fees. ChurchTrac disclaims all responsibility and liability for any discrepancies between estimated and actual fees.
o. No Direct Support. Church Members are not eligible for direct technical support from ChurchTrac. All support requests from Church Members, including issues with account access, online giving, or scheduling, must be directed to Your Church. ChurchTrac may, at its discretion, provide limited assistance to Church Members to resolve Church member issues or issues with the Church Connect Service, but is under no obligation to do so.
p. Third-Party Services and Content. Features such as online giving may rely on third-party services (e.g., Stripe). ChurchTrac does not control and is not responsible for the availability, functionality, performance, accuracy, legality, or security of these services. Use of such services is subject to the third-party provider's own terms and policies, and Church Members are solely responsible for reviewing and complying with them. The Church Connect Services may also display or link to third-party content (e.g., YouTube videos, social media links). ChurchTrac does not endorse, warrant, or assume any responsibility for any third-party content, and disclaims all liability for any damages, losses, outages, breaches, or other issues arising from access to or reliance on such content or third party services.
q. Push Notifications and Tracking. The Church Connect mobile app uses third-party services, including Firebase Cloud Messaging, to deliver push notifications (e.g., event reminders or messages from Your Church). Use of these services requires limited device data (such as device tokens) to be shared with Firebase or similar providers, and such data is governed by the applicable provider's terms and privacy policy (e.g., Google's Firebase Privacy Policy). Church Members may opt in or out of push notifications at any time via their device settings. ChurchTrac may also use cookies, analytics tools, and similar tracking mechanisms within the Church Connect Services to support functionality, security, performance, and user experience. These may collect non-identifiable usage information, such as device type, browser, or activity logs. By using the Church Connect Services, you consent to our use of such tracking mechanisms.
r. Termination by Your Church. Your Church may suspend or terminate a Church Member's access to the Church Connect Services at any time, with or without cause, and without notice.
s. Termination by ChurchTrac. ChurchTrac may suspend or terminate a Church Member's account for violations of these Terms, including but not limited to fraudulent activity, inappropriate content, excessive resource usage, or any other reason, or no reason at all, at our sole discretion. Accounts terminated for violations may be permanently banned, and ChurchTrac may pursue legal action for severe misconduct (e.g., hacking, phishing). Upon termination, Church Members lose access to the Church Connect Services. ChurchTrac also reserves the right to suspend or terminate Your Church Account, at our sole discretion. Provisions of these Terms that survive termination (e.g., ownership, indemnity, liability limitations) remain in effect.
t. Service Availability. ChurchTrac does not guarantee uninterrupted, timely, or error-free access to the Church Connect Services. Access may be unavailable or limited from time to time due to maintenance, updates, system failures, acts of God, network or hosting provider issues, third-party service interruptions, or other factors beyond our control. To the maximum extent permitted by law, ChurchTrac disclaims all liability for any such outages, disruptions, or loss of access. No compensation, refunds, or credits will be provided for any service interruptions or downtime.
u. Compliance with Laws. Church Members must comply with all applicable local, state, national, and international laws and regulations when using the Church Connect Services, including but not limited to data protection and privacy regulations (e.g., GDPR, CCPA, where applicable). Each Church Member is solely responsible for ensuring their own compliance. ChurchTrac disclaims all liability for any non-compliance by Church Members or Your Church. Violations may result in suspension or termination of access, removal of content, and any other remedies available to ChurchTrac at law or in equity.
v. Limitation of Liability. To the maximum extent permitted by law, ChurchTrac shall not be liable to any Church Member or third party for any direct, indirect, incidental, consequential, exemplary, statutory, punitive, or special damages whatsoever, including but not limited to damages for loss of profits, revenue, goodwill, data, use, or other intangible losses, arising out of or related to the Church Connect Services, even if ChurchTrac has been advised of the possibility of such damages and regardless of the theory of liability (contract, tort, negligence, or otherwise). ChurchTrac shall not be liable for any damages resulting from service interruptions, data loss, unauthorized access, errors, omissions, third-party content, or other issues beyond its reasonable control. The sole and exclusive remedy of any Church Member dissatisfied with the Church Connect Services is to discontinue use of the Services.

If you utilize the SongSelect® service, the following additional terms in this section apply to you:
Application refers to the SongSelect application. Content refers to the SongSelect content.
All Content and the Application are provided solely and exclusively for End Users who are active subscribers to SongSelect;
All Content is the intellectual property of a third party, is protected by law, and no ownership, distribution rights, or other proprietary rights in the Content are transferred to the Partner and/or any End User.
CCLI and/or Content Owners may remove Content from the API from time-to- time without notice;
End Users must agree to comply with all SongSelect license terms and all applicable laws, including copyright law in their use of the Content and shall protect CCLI's and the Content Owners' rights;
The usage rights granted to End User are nonexclusive, are subject to revocation or termination at any time, and may not be transferred, assigned, sublicensed, distributed, or conveyed in any manner whatsoever.
CCLI and the Content Owners reserve the right to modify the provisions contained in the EULA at any time.
Neither CCLI nor Content Owners will be liable to End User for any indirect, punitive, incidental, consequential, or special damages of any kind resulting from the use of the SongSelect, the SongSelect API, or from Content made available through the SongSelect API, or for any other damages of any type, nature or description arising out of any legal theory, and End User hereby forever releases and discharges CCLI and Content Owners from any and all liability related to End User's use of or access to SongSelect, the SongSelect API, or Content made available through the SongSelect API (Partner will display this damage limitation in the EULA in conspicuous, bold, capitalized letters in compliance with all legal requirements that such limitations be conspicuous).
Partner and CCLI disclaim any and all express or implied warranties, including, without limitation any implied warranty of merchantability or fitness for a particular purpose (Partner will display these warranty disclaimers and exclusions in bold, capitalized type in compliance with laws which require such disclaimers be conspicuous).
